Terms of Service

These Terms of Service (the “Terms”) are an agreement between you and [legal entity — pending CA/tax-advisor confirmation, see PRD §4](“we”, “us”), which operates Family Tree(the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
1. Who can use the Service
You must be at least 18 years old to create an account. By creating one, you confirm that you are an adult and that the information you give us is accurate.
2. Your account
You are responsible for keeping your login details secure and for activity that happens under your account. Tell us promptly if you think your account has been accessed without your permission.
3. Adding information about your family
The Service lets you record information about other people. This is a responsibility as well as a feature. By adding information about another person, you confirm that:
- you have a proper basis to record and share it — for example, it is your own close family history, or you have the person’s consent;
- the information is accurate to the best of your knowledge; and
- you will respond reasonably if a relative asks you to correct or remove information about them.
People who are the subject of a record but do not hold an account can ask us directly to correct or remove it, as described in our Privacy Policy.
4. Your content
The family information, photos, recordings, and stories you add are yours. You keep ownership of them. You grant us only the permission we need to operate the Service — to store your content, and to display and share it with the people you have chosen to share it with, according to their roles and your privacy settings. We do not claim ownership of your content and we do not use it for advertising.
5. Roles within a tree
A family tree has an owner and can have other members with different levels of access (for example, members who can edit and members who can only view). The owner is responsible for who they invite and what access they grant. We recommend adding a second owner so a tree is never dependent on a single person; where a sole owner becomes unreachable, we offer a manual support process rather than an automatic transfer.
6. Acceptable use
You agree not to use the Service to:
- break the law or infringe anyone’s rights;
- add information about people you have no proper basis to record;
- harass, impersonate, or mislead others;
- upload malicious software or attempt to breach our security;
- copy, scrape, or extract other people’s data from the Service; or
- interfere with the Service’s normal operation.
7. Plans and payments
The Service offers a free tier. Paid plans, when available, will be billed through our payment gateway on the terms shown to you at checkout. Our current intended billing cadence is annual. If a paid plan lapses, we will not delete your family’s data — access to some paid features may be limited, but your existing content stays viewable. Any refunds are handled on the terms shown at checkout and as required by law.
8. Deleting your account
You can delete your account at any time. When you do, we permanently remove your personal data, while content you contributed to a shared tree is kept and re-attributed to an anonymised “Former Member” so that the rest of your family keeps what they relied on. This is described in full in our Privacy Policy.
9. Service availability
The Service is offered on an “as is” and “as available” basis. It is an early-stage product run by a small team, and we cannot promise it will always be uninterrupted or error-free. We do our best to keep it running and to safeguard your data, including keeping backups.
10. Our responsibility to you
To the extent permitted by law, we are not liable for indirect or consequential losses, or for loss of data beyond what our reasonable safeguards are designed to protect against. Nothing in these Terms limits any liability that cannot lawfully be limited.
11. Your responsibility to us
You agree to be responsible for claims that arise from content you add in breach of these Terms — in particular, information you record about other people without a proper basis to do so.
12. Suspension and termination
We may suspend or close an account that seriously or repeatedly breaches these Terms, or where we must do so to comply with the law or protect other users. Where it is reasonable to do so, we will tell you why.
13. Changes
We may update the Service and these Terms over time. When we make a material change to the Terms, we will update the “Last updated” date and, where appropriate, notify you. Continuing to use the Service after a change means you accept the updated Terms.
14. Governing law and grievances
These Terms are governed by the laws of India, and the courts of [city], India will have jurisdiction, except where mandatory local law gives you other rights. For any complaint, you can contact our Grievance Officer, [Grievance Officer name], at [contact email — e.g. privacy@your-domain], and we will address it within the timeframes required by applicable law.
